Last year, owner Scott Rosenberg was forced to shut the doors on his shop on East Boston Post Road due to zoning discrepancies regarding the business. Ultimately, a State Supreme Court judge chose to dismiss his case against the village, where he sought $300,000 in damages after being told to close.

Less than a year later, the two sides have reunited, an application for a 3,000-square-foot location on Mamaroneck Avenue has been approved. The new location is scheduled to reopen in the spring. The plan includes a small snack shop that will be open year-round that will serve select foods.

At the time of the court case, Rosenberg’s attorney Andrew Schriever argued that the July 14 closure of Ralph's was a violation of his constitutional rights. He contended that the village had granted Rosenberg a business permit and the illegally rescinded it after he has spent more than $300,000 to meet their demands to work with the neighborhood.

The issues arose when a group of Mamaroneck residents complained to the Zoning Board of long lines and noise coming from the business. In response, Rosenberg hired extra staff, realigned parking and expanded to a larger building, all for naught.

However, the Zoning Board revoked Ralph’s certificate of occupancy and adopted a resolution that denied his application for a special use permit. Now, with fences mended, Rosenberg and village officials are hopeful that the new location will be beneficial for all parties.
