Man Sentenced In Fatal Saw Mill Parkway Crash

MOUNT VERNON, N.Y. – A Mount Vernon man that was convicted on two counts each of criminally negligent homicide and third-degree assault following a July 2012 car crash on the Saw Mill River Parkway in Yonkers has been sentenced to a maximum of four years in prison on Monday.

Shortly after noon on July 12, 2012, Kenyatta Garner, 38, was driving a black 2010 Mercedes Benz – well above the 55 miles per hour speed limit – with four passengers in the car as he approached an exit ramp.

According to Westchester County District Attorney Janet DiFiore, as he approached the ramp, he sharply veered into another lane and slammed into the rear end of a Honda. In an attempt to correct his vehicle, Garner struck a concrete barrier and flipped several times before the Mercedes came to a rest more than 500 feet away from the point of impact.

Two passengers sitting in the back of the car were ejected from the vehicle during the accident, and died. A third had her injuries treated at Jacobi Hospital, while Garner spent several weeks rehabilitating before being transported to Westchester County jail.

During their investigation, county police discovered that the Mercedes was taken from a parking garage in Manhattan without the owner’s knowledge or consent. There is reportedly no connection between Garner, his passengers and the owner of the vehicle.

Assistant District Attorney Shameika Mathurin, of the Superior Court Trail Division, was the lead prosecutor in the case.
