Cortlandt Man Charged With DWI Had 1-Year-Old In Car, Police Say

CORTLANDT, N.Y. -- A Cortlandt man has been charged with aggravated driving while intoxicated under Leandra's Law, which is a Class E felony, state police said.

Subsequent to a vehicle and traffic stop conducted on East Main Street in Cortlandt on Saturday, Javier J. Erraez-Patino was found to be intoxicated, according to police. Erraez-Patino was charged with Aggravated DWI under Leandra’s Law due to the fact that his 1-year-old son was in the vehicle at the time of the stop.

Erraez-Patino provided a positive breath sample that yielded a Blood Alcohol Content of .08 percent, said police. 

 He was arraigned at the Town of Yorktown Court and remanded to Westchester County Jail on $1,000 bail.
